Taylor Swift Fans Drop Live Nation Class Action Suit

In an unexpected twist, the lead plaintiff, Michelle Sterloff, has voluntarily dropped the class action lawsuit against Live Nation concerning the tumultuous ticket sales for Taylor Swift’s Eras Tour. The dismissal notice, submitted on December 12, comes after both parties mutually agreed to a temporary halt, engaging in settlement discussions through mediation.

The lawsuit, initiated nearly a year ago, emerged in the aftermath of the Eras Tour ticketing debacle. Allegations suggested that Ticketmaster, owned by Live Nation, breached federal antitrust and unfair competition laws, deceiving consumers during the tour ticket sales.

The complaint accused Ticketmaster of intentionally misleading fans, promising to prevent bots and scalpers from participating in presales. However, a surge in website traffic, attributed to 14 million unverified Ticketmaster users and a substantial number of bots, led to millions of fans being unable to secure tickets during the TaylorSwiftTix Presale and the Capital One Presale.

The Swifties’ Stand

At a March hearing, Swifties congregated at the U.S. District Court in Los Angeles to voice their frustrations with the malfunctioning ticketing system. Co-plaintiff Julie Barfuss emphasized, “The system is broken, it’s not working for fans…fans are the reason for the live experience, they need to do better.”

The Unveiling Settlement Discussions

Despite the dismissal, uncertainty looms regarding whether a settlement has been reached. The August court filing indicated ongoing settlement discussions, scheduled to conclude by January 31, 2024. Both Sterloff’s lawyers and Live Nation representatives have not provided immediate comments.

The Eras Tour ticketing chaos intensified scrutiny on Live Nation and Ticketmaster. A Senate Judiciary Committee hearing on live music business competition transpired in January, and the Department of Justice has been investigating the companies. Recently, the Senate introduced the “Fans First Act” to address ticketing system issues, including hidden fees and bot-related scalping.
